Politika povrata proizvoda – Refund and Returns Policy

Poštovani kupci,

Obaveštavamo vas da se kupovina putem našeg portala www.chiccode.rs smatra prodajom na daljinu u skladu sa Zakonom o zaštiti potrošača („Službeni glasnik Republike Srbije“, br. 88/2021).

Prema ovom zakonu, kupac koji se smatra potrošačem (fizičko lice koje kupuje proizvode za lične potrebe, a ne u poslovne svrhe), ima pravo da odustane od ugovora u roku od 14 dana od dana prijema proizvoda. Kupac može odustati od ugovora bez navođenja razloga.

Pravo na odustajanje i vraćanje proizvoda

Kupac je dužan da vrati proizvod najkasnije u roku od 14 dana od dana kada je poslao obrazac za odustajanje. Nakon ovog roka, proizvod se više ne može vratiti.

Vraćanje proizvoda je moguće samo ako su ispunjeni sledeći uslovi:

Proizvod mora biti nekorišćen, neoštećen i u originalnom pakovanju, sa svim pratećim dokumentima (garantni list, uputstvo itd.).
Uz proizvod mora biti priložen originalni fiskalni račun.
Kupac je odgovoran za svaki nedostatak ili oštećenje proizvoda nastalo usled nepravilnog rukovanja. Ukoliko se utvrdi da je proizvod oštećen krivicom kupca, povraćaj cene proizvoda neće biti moguć, a proizvod će biti vraćen o trošku kupca.

Cena proizvoda će biti vraćena tek nakon što se utvrdi da je proizvod neoštećen i u dobrom stanju.

Izuzeci od prava na povraćaj proizvoda

Zakon o zaštiti potrošača isključuje pravo na povraćaj proizvoda u sledećim situacijama:

Isporuka zapečaćenih audio, video snimaka ili računarskog softvera koji su otpečaćeni nakon isporuke,
Isporuka proizvoda proizvedenih prema posebnim zahtevima potrošača ili jasno personalizovanih,
Isporuka proizvoda koji je podložan pogoršanju kvaliteta ili ima kratak rok trajanja.
Reklamacije na proizvod

Kupac može podneti reklamaciju zbog neusaglašenosti robe sa ugovorom, pravima iz garancije, pogrešno obračunatih cena ili drugih nedostataka, na sledeće načine:

Troškove slanja reklamacije snosi kupac.

Uz imejl treba dostaviti račun ili dokaz o kupovini (kopiju računa, slip i sl.).
Rokovi za odgovor na reklamacije

Prodavac je dužan da odgovori kupcu na reklamaciju u roku od osam dana od prijema reklamacije, ili da kupca obavesti o broju pod kojim je reklamacija zavedena u evidenciji. Rok za rešavanje reklamacije ne može biti duži od 30 dana.

Reklamacije na štetu nastalu transportom

Ako je proizvod oštećen tokom transporta, reklamaciju treba prijaviti u roku od 24 sata od prijema proizvoda.

We inform you that purchases through our portal www.chiccode.rs are considered distance selling in accordance with the Consumer Protection Act (Official Gazette of the Republic of Serbia, No. 88/2021).

According to this law, a buyer who is considered a consumer (a natural person who purchases products for personal needs, not for business purposes), has the right to withdraw from the contract within 14 days from the date the product was received. The buyer may withdraw from the contract without having to state a reason.

Right to withdraw and return the product

The buyer is obliged to return the product no later than 14 days from the date he sent the withdrawal form. After this period, the product can no longer be returned.

Returning the product is possible only if the following conditions are met:

The product must be unused, undamaged and in its original packaging, with all accompanying documents (warranty certificate, instructions, etc.).
The original fiscal receipt must be enclosed with the product.
The buyer is responsible for any defect or damage to the product caused by improper handling. If it is determined that the product was damaged through the buyer’s fault, a refund of the product price will not be possible, and the product will be returned at the buyer’s expense.

The price of the product will be refunded only after it is determined that the product is undamaged and in good condition.

Exceptions to the right to return the product

The Consumer Protection Act excludes the right to return the product in the following situations:

Delivery of sealed audio, video recordings or computer software that have been unsealed after delivery,
Delivery of products manufactured according to the consumer’s special requirements or clearly personalized,
Delivery of a product that is subject to deterioration in quality or has a short shelf life.
Product complaints

The buyer can file a complaint due to non-conformity of the goods with the contract, rights under the warranty, incorrectly calculated prices or other defects, in the following ways:

The costs of sending the complaint are borne by the buyer.

The invoice or proof of purchase (copy of invoice, slip, etc.) should be submitted with the e-mail.
Deadlines for responding to complaints

The seller is obliged to respond to the complaint to the buyer within eight days of receiving the complaint, or to inform the buyer of the number under which the complaint is registered in the records. The deadline for resolving the complaint cannot be longer than 30 days.

Complaints about damage caused by transport

If the product is damaged during transport, the complaint should be reported within 24 hours of receiving the product.
